Q: Allah decreed that my brother (S. Y. F.) was involved in a traffic accident, and he died as a result, as did the other party (H. T. D.). The traffic department assigned 100% of the fault to my brother and ruled that we must pay blood money to the heirs of (H. T. D.), to be paid at the end of Ramadan 1408 AH. My congregation
collected the blood money among themselves equally and presented it to me to submit to the court that issued the ruling. When I called to make an appointment with the agent of the heirs of (H. T. D.), I was informed that a doer of good had presented a check for the amount to settle the blood money. My question is: Do I have the right to dispose of the money in my capacity as agent for the heirs, since my father asked me for some of it because he has an urgent need for it to cultivate our farm and revive some of our assets? Do I have the right to take some of it? Please inform us of the correct path, may Allah reward you.
A: It is obligatory to return to your congregation what was taken from them for the purpose of settling the blood money for your brother, as long as the purpose for which it was collected has ended, unless the group waives their claim, in which case it belongs to the one to whom they waived it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
