Fatwa number ( 19396 )
Q: A man has a wife whose mother passed away - may Allah have mercy on her - and she had not reached one year of age. In return, there is a child whose mother passed away - may Allah have mercy on her - and he had not reached one year of age. That child and the girl lived with their maternal grandmother from a young age. They lived in that house until the girl got married and the boy got a job. The question: Is there a prohibited relationship between them or not? May Allah preserve you and guide your steps to the path of good.
A: The mere care of this child and the girl by their maternal grandmother and their living with her does not establish a prohibited relationship between them. This girl is the child’s maternal aunt, and he is her maternal uncle. She is a stranger to him, and it is permissible for him to marry her, unless it is established that their grandmother or another woman breastfed them a breastfeeding that establishes a prohibited relationship
(five breastfeedings or more) within the two-year period; in that case, the prohibited relationship is established, and the child becomes the brother of this girl through breastfeeding in this situation. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
