The first question of fatwa number ( 8420 )
Q1: A man was married for twenty years or more, but after that he married a second time. After his marriage, he divorced his first wife, but after three months his second wife went and he took the first one back into his guardianship, but he does not speak to her even though she is under his guardianship. He enters the house and eats from the food and drink that is served to him, but he does not speak to her or talk to her. This state continued for a full year, and the righteous people tried to reconcile them, but he kept refusing. What is the ruling of the Shari'ah in this matter?
A1: The evidence of the Shari'ah has come regarding good treatment between the spouses. It is obligatory for the husband to hold onto his wife with kindness and excellence in worship, and it is forbidden for him to hold onto her to harm her or to inflict pain upon her. Also, it is permissible for the woman, if she dislikes her husband because of his bad treatment, to seek separation from him, even if it is through the ruling of the judicial authority.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
