Fatwa number ( 11189 )
Q: I have a sister who wears the niqab, prays, fasts, and fears Allah, and we do not declare anyone pure before Allah. She is married and has three sons and two daughters. She has been married for fifteen years, and her husband abandons prayer except in Ramadan or on some other occasions. He does not perform the ritual bath for major ritual impurity for two or three days, and he does not pray Friday prayer or take a bath for it. He does not pay the zakah of his wealth. He deals with banks. He sits with bad friends who are known for that. He goes to European countries and some Arab countries for the purpose of recreation and leisure, and these European countries are famous for open sinfulness and lewdness. My sister, his wife, sometimes eavesdrops on him when his bad friends are with him, and she hears him talking to his friends about his adventures during his trips in a way that the tongue is too modest to mention. He loves free mixing of men and women and is drawn to women in a shameful and attention-grabbing manner. Recently, a man of religion met him, advised him, encouraged him to seek Paradise, and strongly warned him of Allah's punishment. So the husband returned to praying and performing the ritual bath for major ritual impurity, but he delays in paying the zakah. He still deals with interest-based banks. And when he mixes with the opposite sex at a party or a wedding, he loses himself and talks, laughs, and jokes with women. Our noble Shaykh, my sister constantly advises and guides this husband,
but she hides from her father the matter of her husband in this form, which, if he knew and learned about this husband, might lead him to divorce his daughter from him. The husband does not care about anything, not about the wife or the children. Now: 1 - Does sin attach to my sister -the wife- due to her silence about him and not informing her father of his behavior and the truth of his matter? 2 - Does the money the husband spends on my sister and her children from this wealth -the banks- does it attach to her any sin or disobedience? 3 - If the husband returns to his previous state and abandons prayer and strays from the path, what is the position of the wife? And is her living with him in this manner for the sake of raising the children forbidden or permissible? Please inform us, may Allah reward you, and may He reward you with good for us and for Islam and the Muslims.

A: If the matter is as mentioned, then it is obligatory for your sister to inform her father of all her husband's conduct so that he can work to free her from him; because freeing her from him is obligatory. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
