Q1: What is the answer, in terms of Shari'ah and truth, regarding the one who left his wife and traveled for a year or more to work to provide his family with what is sufficient for their livelihood? Knowing that there are others whose absence is not just for that, but they build palaces and buy buses and the like of the adornments of this worldly life. There is no doubt that this long absence leads to zina, either from the man or from the woman. We ask Allah for guidance and success.
A1: If the husband and wife agree on the absence, whether it is long or short, with chastity, there is no harm on them. If one of them fears for himself from the absence—even if there is a need for it to earn a living—he asks his
partner for his right, in a way that achieves reunion; to preserve honor, to achieve chastity, and to protect the private parts. If he refuses, the one in need should refer the matter to the judge to rule between them according to what Allah has prescribed. It is known that it is not necessary that the one who is not with his wife, or the one who is not with her husband, will commit zina, even if the period is long. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
