Q1: What is the answer, in terms of the Shari'ah and truth, regarding the one who leaves his wife and travels for a year or more to work in order to provide his family with what is sufficient for their livelihood? Knowing that there are others whose absence is not for that reason alone, but rather they build palaces and buy buses and the like of the adornments of this worldly life,
and there is no doubt that this long absence leads to unlawful sexual intercourse, either from the man or from the woman. We ask Allah for guidance and success.
A1: If the husband and wife agree on the absence, whether it is long or short, with chastity, then there is no blame on them. If one of them fears for himself from the absence, despite the need for it to earn a living, he asks his partner for his right in a way that ensures their meeting; to preserve honor, achieve chastity, and protect the private parts. If he refuses, the one in need refers the matter to the judge to rule between them according to what Allah has legislated. It is known that it is not necessary that one who is not with his wife, or one who is not with her husband, will commit unlawful sexual intercourse, even if the period is long. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
