Q: We are young Muslims, praise be to Allah, from Egypt, but we reside in the Netherlands, and we ask about the Islamic ruling on some young Muslims who resort to marrying European women or some foreign women who have residency papers, in order to obtain residency in the Netherlands, knowing that this marriage is nominal, i.e., ink on paper, as they say, meaning that he does not live with her or treat her as a wife; he only goes with her to the government building with two witnesses, and the contract is notarized, and after that each goes their own way in exchange for the woman receiving a large sum of money. Is it permissible for a Muslim to resort to this ruse to obtain residency, given the poor economic conditions that Egypt is going through? What is also the ruling in the Shari'ah on the money the woman acquires through this means? Please reply, may Allah reward you, to enlighten many young Muslims who fall into this problem.
A: The marriage contract is among the contracts whose great status Allah has emphasized, and He called it a solemn covenant, so it is not permissible to conclude a marriage contract that is not based on reality for the purpose of
obtaining residency. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
