Q 1, 2: We have in Egypt customs and traditions, one of which is: preventing the marriage of the younger daughter before the older one. Is there any evidence that negates this? What is the ruling on adhering to these customs and traditions? And when do these customs and traditions take precedence over the Shari'ah? There is a hadith that says: . Is this hadith authentic? If so, I ask Allah the Mighty and Majestic to clarify for us the jurisprudence of this hadith, when it is to be applied, and on what basis it is applied. Is it permissible to apply it in this matter we mentioned earlier, or is it considered injustice to the younger one, or does every matter have its own jurisprudence?
A 1, 2: The principle is the permissibility of marrying daughters absolutely, whether older or younger; based on the saying of Allah the Exalted: . If a woman is proposed to by her guardian, the conditions are met, and the obstacles are removed, then he should marry her. This custom—giving the younger daughter precedence over the older one in marriage—is not contrary to the Shari'ah. As for the hadith: Sahih Muslim 2363 , it is authentic, narrated by Muslim in (his Sahih), and its meaning is: that people are more knowledgeable about the affairs of their worldly lives and their management, such as agriculture, various types of crafts, tailoring, and trade, and the like, while observing the ruling of the Shari'ah in everything. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
