Q: Among the customs prevalent in these times is that when a man contracts the marriage of his daughter or sister, he sets for her a present bridal gift and a deferred bridal gift that the husband pays her at the time of divorce, and they call it: the debt of the conscience. Is this deferred bridal gift called the debt of the conscience permissible or not? And if it is permissible, then if the husband dies without divorcing her, does it become a debt in his conscience or not?
A: It is permissible for the entire bridal gift to be paid in advance, or for the entire amount to be deferred, or for part of it to be paid in advance and part deferred. Whatever is deferred must be paid when its due date arrives, and whatever has no specified due date must be paid by him when he divorces her, and it is paid from his estate if he dies. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
