The wife is entitled to the full mahr upon consummation

Machine translationRead the Arabic original
Fatwa number ( 360 )
Q: My brother (T. S. T) married a Lebanese woman with a mahr of seven thousand pounds. He paid two thousand pounds as the advance mahr, and the remaining five thousand pounds was the deferred mahr, to be paid after twenty years. Allah willed it, and my aforementioned brother passed away two years after their marriage, and she did not bear him any children during this period. She inherited from him along with the other heirs. Is she entitled to inherit and also take her deferred mahr? Even though the custom is that the deferred mahr is not paid except in the case of divorce, and this was not mentioned in the contract. Therefore, I ask you to issue a fatwa for me.

A: The wife is entitled to the full mahr upon consummation. What the questioner mentioned regarding the death of his husband, that the deferred mahr is to be paid after twenty years, that she inherited from him along with the other heirs, that the custom is that the deferred mahr is not paid except in the case of divorce, and that this was not mentioned in the contract, all these matters do not negate the principle mentioned previously. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
