Fatwa number ( 9765 )
Q: Rafi'ah bint Muhammad 'Abd al-'Aziz al-Dawusi passed away, leaving behind four sons: 'Aydah, Saleh, 'Ubayd, and 'Abd Allah, and daughters: Fatimah, Qawwat, Badi'ah, Hamla, and Hiba. It is known that one of the daughters works with
the deceased Rafi'ah, and they are: Badi'ah and Hamla. Rafi'ah, the deceased, intended to absolve her responsibility regarding the labor of her two daughters who were helping to maintain the house with their mother Rafi'ah. Is it permissible to take some of the estate's wealth for the two daughters before the distribution of the inheritance or not?
A: After settling the deceased's debt, if she was in debt, and executing her lawful bequest, if she made one, the estate is distributed among the heirs, each taking his or her lawful share from it. No one of them is given something for his or her service to his or her mother that distinguishes him or her from the rest of the heirs. His or her wage for serving his or her mother is considered dutifulness to her, for which he or she hopes for reward from Allah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
