Q4: My mother (may Allah have mercy on her) passed away and did not receive her share of her husband's estate - my father (may Allah have mercy on him) - because we did not distribute that estate. All of the estate my late father left behind, we placed in a building - real estate - which was in my father's possession before his death, in order to complete some deficiencies regarding the building. I did not place that estate in the aforementioned building except after the consent of all the heirs, as well as the consent of the judge in the town, and the building belongs to all the heirs.
A4: If your mother was in debt, her debt is paid from her estate. Likewise, if she made a bequest, her lawful bequest is executed within the limit of one-third, and what remains after that belongs to her heirs. This includes what she left of her own money and what she inherited from her husband. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
