The first question of Fatwa number ( 10706 )
Q1: I am a woman confused about my situation, as a doer of good came to me and gave me five hundred riyals as charity for my father. I took it to my father, and he said, "Keep it with you as a kind of trust," as he was advanced in age, and he passed away
and my father is deceased, and the aforementioned amount is with me. I engaged in buying and selling with it for my father, and I gave charity from it for him and sacrificed from it for him. Is it permissible to dispose of it for him, or is it inheritance? Please inform us, may Allah reward you with good.
A1: First: The wealth left by the deceased is first used to pay off his debts, then his lawful will is executed if there is one, and the remainder belongs to the heirs. Second: If all the heirs agree to dispose of what he left or distribute it to the poor, for example, there is no blame on them, and they have a reward in that. Third: What was spent for him from the guarantee and the annual custom should be referred back to the entity responsible for the expenditure. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
