Fatwa number ( 17009 )
Q: I have a young man who is 24 years old. He was a Christian, but Allah guided him to what He loves and is pleased with, and he embraced the religion of Islam in Egypt . He is of Egyptian nationality. He left his parents, his wife, and his son, who is 3 years old. However, he traveled outside the country seeking to build his future. He receives messages from his mother and sends her some money, saying that it is maintaining family ties. Is it permissible to correspond with and provide for his Christian mother while he is a Muslim? The Muslim brother asks about reviewing his marriage with his wife if she agrees and she becomes Muslim and returns to him. Will there be a new marriage contract, or the contract
The first contract is sufficient. And if she refuses Islam but agrees to live with him, is it permissible for a Muslim to marry a Christian woman, and what will be the fate of the children—will they be Christians or Muslims? But he is determined to marry a Muslim woman if his first wife refuses Islam. We are trying to reconcile him with his wife for the sake of the child. Currently, they are separated without divorce for 4 years. Please inform us; may Allah reward you and grant you the best reward for us.

A: First: It is obligatory for a son to provide for his disbelieving mother. He must treat her kindly, be dutiful to her, and maintain ties with her to the extent of his ability. Allah the Exalted said:
But if they endeavor to make you associate with Me that of which you have no knowledge, do not obey them but accompany them in [this] world with appropriate kindnessوَإِنْ جَاهَدَاكَ عَلَى أَنْ تُشْرِكَ بِي مَا لَيْسَ لَكَ بِهِ عِلْمٌ فَلا تُطِعْهُمَا وَصَاحِبْهُمَا فِي الدُّنْيَا مَعْرُوفًا
[Luqman 31:15]
And the saying of the Prophet (peace and blessings be upon him) to Asma' (may Allah be pleased with her) when she asked him about her mother, who had come to her while she was a disbeliever: "Should I maintain ties with her?" He said to her: "Maintain ties with your motherولقول النبي لأسماء رضي الله عنها لما سألته عن أمها وقد قدمت وهي مشركة: أفأصلها؟ فقال لها: "صلي أمك
. Second: If the husband embraces Islam and then the wife embraces Islam, they remain in the previous marriage contract, and it does not need to be renewed. Third: If the wife is a Christian and refuses to enter Islam, it is permissible for the husband to continue with her; because the original ruling is that it is permissible
for a Muslim to marry a chaste woman from the People of the Book. Fourth: As for the children, they follow the better of the two parents in religion. If one of the spouses embraces Islam, the ruling is that all minor children are considered Muslim; because a minor follows the better of the two parents in religion. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
