Q: I am a Muslim man from the country of India . I married an Indian girl who was a Hindu. Because I learned many methods of da'wah from the lectures and debates of the scholar Ahmad Deedat , I invited her to the pure Islam, and she accepted Islam. I married her fifteen days after her conversion. I learned that she had been expelled from her family's home before I married her, and she said that they expelled her because she embraced Islam. I married her on March 25, 1989. I discovered that she was not a virgin, and she claims that this was due to her practicing sports, especially horseback riding. As for me, I have forgiven her for everything in her past life. Then she became pregnant, and a medical examination indicated that her delivery date would be October 4, 1989. My family became suspicious of this because of the early delivery date. They pressured her at home, with my stepmother tormenting her and forbidding her from eating with them. Then she was expelled from the house, and I housed her in a room 1000 km from our area. She gave birth on October 17, 1989, after six and a half months, or 29 weeks, of pregnancy. My family rejected this newborn and his mother, regardless of the excuses and reasons. She says that the newborn is my son. I took her to six doctors, including a friend of mine, all of whom are
Hindus by religion. They all said that the child was born from his mother's womb after nine months of pregnancy, and they said that if he had been born after six and a half months, he would have had to be placed in an incubator for one month; however, he was placed in the incubator for only three days. My family is strongly insisting that I divorce her, and I do not know what to do. Is the child really my son? My wife has no one but me, and if I leave her, it is possible that she will return to false beliefs against her will, and the child will be with her. Is this newborn really my son? And if he is not my son, what should I do to preserve the Islam of the mother and the newborn? Please advise me.

A: The minimum duration of pregnancy is six months. Allah the Exalted said:
And We have enjoined upon man, to his parents, good treatment. His mother carried him with hardship and gave birth to him with hardship, and his gestation and weaning [period] is thirty months.وَوَصَّيْنَا الْإِنْسَانَ بِوَالِدَيْهِ إِحْسَانًا حَمَلَتْهُ أُمُّهُ كُرْهًا وَوَضَعَتْهُ كُرْهًا وَحَمْلُهُ وَفِصَالُهُ ثَلاثُونَ شَهْرًا
[Al-Ahqaf 46:15]
And Allah the Exalted said:
and his weaning is in two yearsوَفِصَالُهُ فِي عَامَيْنِ
[Luqman 31:14]
The two years are twenty-four months, so what remains from the thirty is six months, which is the minimum duration of pregnancy. Therefore, the newborn is your son.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
