The third question of Fatwa No. (8576)
Q3: What is the ruling in Islam if a man marries a woman and only six months pass, then the woman gives birth to a child; is he truly his father or not? And likewise, if the woman is from the most truthful of people, is he his father or not?
A3: If a woman gives birth after six months or more following her husband’s entry into marital relations with her, the child belongs to the husband; because the minimum duration of pregnancy is six months; due to the saying of Allah the Exalted:
and his gestation and weaning [period] is thirty monthsوَحَمْلُهُ وَفِصَالُهُ ثَلاثُونَ شَهْرًا
[Al-Ahqaf 46:15]
along with His saying:
and his weaning is in two yearsوَفِصَالُهُ فِي عَامَيْنِ
[Luqman 31:14]
If the period for weaning is taken as two years: twenty-four months, then nothing remains for the pregnancy except six months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
