Q: I haveproposed my brother Hamd ibn 'Ali to Muhammad ibn Jibrin Fadhil, and he married her to me. We paid six thousand in cash and five thousand in deferred payment, to be paid over five years. After we got married and three months had passed, he came to me and proposed for his son.So I held back until I could ask about the ruling. What is the ruling in this case?
A: If the first marriage was completed and there was no prior agreement at the time of the first marriage to make the marriage of the second daughter a substitute for Hamd ibn Ali’s marriage to the first daughter, and this arrangement did not affect the amount of the mahr, then the marriage of Muhammad ibn Jubayn Fadl’s son to the daughter he proposed for from Jabir ibn Ali is permissible. However, if there was a prior agreement to make the second a substitute for the first, or if this substitution affected the amount of the mahr, then it is not permissible.
