The first question of Fatwa No. ( 13586 )
Q1: A man's father passed away, leaving behind three brothers and two sisters. When their eldest brother came to divide the inheritance among them, one of the sisters said to him: "I am forgiving you of my right, and I do not know whether she forgave this sister out of shyness or out of genuine goodwill." What should we do? Do we accept it from her or not? And this inheritance she forgave is a piece of land with fig or olive trees? Please advise us, may Allah reward you with good.
A1: If it is known that the woman forgave her share of her father's inheritance to her siblings out of genuine goodwill, then there is no harm in that. However, if she was not truly willing to do so, her share of the inheritance must be given to her. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
