Q: A man married several wives, but he was not blessed with any children from them. He felt compassion for children and vowed to Allah that if He blessed him with children, he would sacrifice a *fatir* (a camel in its first year) for each child. He was blessed with fifteen children: nine sons and six daughters. He sacrificed five *fatir*, but was unable to complete the rest. This man has passed away, but before his death, he stated that he intended the vow to apply only to the sons, not the daughters. He left behind a small amount of money, and his children wish to fulfill their father's vow. What is your esteemed opinion on this? Is it permissible to sacrifice young camels, given that they are available in the markets and *fatir* are not? If that is permissible, how should they be slaughtered and distributed? Note that the vow-maker, Ali 'Ali al-Mutayri, has passed away. The heirs state that the deceased left behind only a simple house, and that one-third of his wealth was not set aside, as his death was sudden and he did not express what he was saying clearly. The house was sold for sixty thousand, which the heirs have not yet received. The questioner also mentions that *fatir* are not currently sold or slaughtered, and if sold for milk, they are very expensive. The deceased left behind seven sons, five daughters, and two wives. They wish for a written answer to rely upon. May Allah preserve you.
A: First: If the situation is as described, where your father made a vow and sacrificed part of what he vowed, and *fatir* were not available for him, then his children should sacrifice on his behalf the remaining *fatir*
from the proceeds of the house. If the proceeds are insufficient, then those of his children who wish to fulfill the vow on his behalf should sacrifice the remaining *fatir* if they are able to do so; based on the saying of Allah the Exalted:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
. Second: If he died without bequeathing one-third, then it is not obligatory for you to pay anything on his behalf. It is recommended that you do him good by giving charity from what your hearts find pleasing, and that you call upon Allah for mercy and forgiveness for him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
