Fatwa No. ( 6293 )
Q: A man married several wives, but he was not blessed with any children from them. He was concerned about the children, and he vowed to Allah that if he were blessed with children, he would slaughter a fatir for each child .. He was blessed with fifteen children: nine sons and six daughters. He slaughtered five fatirs, but he was unable to complete the rest. This man has passed away, but before his death, he stated that he intended the vow to apply only to the sons and not the daughters. He left behind a small amount of money, and his children wish to fulfill their father's vow. What is your esteemed opinion on this? Is it permissible to slaughter young camels given their availability in the markets and the unavailability of fatirs? If that is permissible, how should they be slaughtered and distributed? It is known that the one who made the vow, referred to as (A. A. M.), has passed away. The heirs state that the deceased left behind only a modest house and did not bequeath a third of his estate, as his death was sudden and he did not understand what was being said. The house was sold for sixty thousand, and the heirs have not yet received their share of the inheritance. The questioner mentions that fatirs are not sold or slaughtered at this time, and if sold for milk, they are very expensive. And behind
the deceased are now seven sons, five daughters, and two wives. They want a written answer to rely upon. May Allah preserve you.
A: First: If the situation is as described, regarding your father's vow and his slaughtering of part of what he vowed, and if fatirs were not available for him, then his children should slaughter for him the remaining fatirs from the proceeds of the house. If the proceeds are insufficient, then those of his children who wish to fulfill the vow on his behalf should slaughter the remaining fatirs if they are able to do so; based on the saying of the Exalted:[At-Taghabun 64:16] Second: If he died without making a bequest, it is not obligatory for you to pay out a third on his behalf after fulfilling the vow. It is recommended that you do him a favor by giving charity from what your hearts find pleasing, and that you call upon Allah for mercy and forgiveness for him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
