The fourth question of the fatwa number ( 4461 )
Q4: If a person enters the state of ihram on the last day of Ramadan and does not reach the House until the first night of Shawwal, is he performing tamattu' or not? And if a person enters the state of ihram from Jeddah without entering ihram from the miqat until he reaches the House, performs tawaf around the House, and sa'y between al-Safa and al-Marwah , then goes out to Madinah , and when he returns to Makkah he enters the state of ihram from Madinah to Makkah , performs tawaf around the House, and sa'y between al-Safa and al-Marwah , does this tawaf suffice for him regarding the blood (sacrifice) due for the first one, or not?
A4: First: If a person enters the state of ihram for 'Umrah at the end of Ramadan and does not perform tawaf or sa'y for it until the first night of Shawwal, then exits the state of ihram, and then performs Hajj in
his year, he is not considered to be performing tamattu' from 'Umrah to Hajj; because his entering the state of ihram for 'Umrah was not in the months of Hajj. Second: If a person enters the state of ihram for 'Umrah after passing the miqat and performs it, then travels to Madinah and enters the state of ihram for another 'Umrah from the miqat and performs it, the second 'Umrah does not remove from him the blood (sacrifice) that became obligatory upon him due to passing the miqat without entering the state of ihram for the first 'Umrah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
