The questioner : And this is his second question. He says: A man entered the state of ihram for 'Umrah during the months of Hajj, performed tawaf and sa'y, then went to Madinah for visitation, and entered the state of ihram from 'Abraq for Hajj alone. Is he considered to be performing tamattu' based on the previous 'Umrah or not?

The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and all his Companions. As long as this man, when he performed 'Umrah during the months of Hajj, intended to perform Hajj in that same year, he is considered to be performing tamattu'. This is because his travel between the 'Umrah and the Hajj does not invalidate the tamattu', unless he returns to his home and starts the journey from his home to Hajj. In that case, his tamattu' is severed because he separated each act of worship with an independent journey. So this man who went to Madinah after completing the 'Umrah, then entered the state of ihram for Hajj from 'Abraq, is obligated to offer the sacrificial animal for tamattu' due to the generality of the statement of Allah the Exalted:
then whoever performs 'umrah [during the Hajj months] followed by Hajj [offers] what can be obtained with ease of sacrificial animals. And whoever cannot find [or afford such an animal] - then a fast of three days during Hajj and of seven when you have returned [home]. Those are ten complete [days]. This is for those whose family is not in the area of al-Masjid al-Haram فمن تمتع بالعمرة إلى الحج فما استيسر من الهدي فمن لم يجد فصيام ثلاثة أيام في الحج وسبعة إذا رجعتم تلك عشرة كاملة ذلك لمن لم يكن أهله حاضري المسجد الحرام
