Q1: I came from Egypt to work in Saudi Arabia , and my job is in al-Madinah al-Munawwarah , but I will land in Jeddah and I want to perform 'Umrah, knowing that I have not entered the state of ihram from the miqat. Is it permissible for me to enter the state of ihram directly from Jeddah , or should I stay there for three
days to equal the resident, and then perform the 'Umrah?

A1 : One who comes from Madinah intending to perform 'Umrah must enter the state of ihram from the miqat of the people of Madinah , namely: Abwar 'Ali . Even if he has work in Jeddah , this does not exempt him from entering the state of ihram from the aforementioned miqat. If he delays entering the state of ihram and enters it from Jeddah , he has erred and left an obligatory duty. For leaving it, he must slaughter a fidyah, which is: a sheep, or one-seventh of a camel, or one-seventh of a cow. He slaughters it in Makkah and distributes it to the poor, and he does not eat any of it; because it is an expiation for what he did. This is based on the saying of the Prophet (peace and blessings be upon him) when he designated the miqats:
and those (Mawaqit) are also meant for those who live at these (places) and for those too who come from without towards them for the sake of Hajj or 'Umraهن لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة
Sahih Muslim 1181a
. If he returns before entering the state of ihram and enters it from the miqat, he owes nothing. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
