Q: I found that the nights of Mina are three; therefore, the pilgrim must stay overnight in Mina for two nights if he is hurrying, or three nights if he is not hurrying. This is in the statements of the Shari'ah in books of jurisprudence, including the book *Muntaha al-Iradat* and the book *al-Rawd al-Murba'* (a commentary on *Zad al-Mustaqni'*). And in the statements of the exegetes regarding the verse, Allah the Exalted said:
Then whoever hastens [his departure] in two days - there is no sin upon him; and whoever delays [until the third] - there is no sin upon himفَمَنْ تَعَجَّلَ فِي يَوْمَيْنِ فَلا إِثْمَ عَلَيْهِ وَمَنْ تَأَخَّرَ فَلا إِثْمَ عَلَيْهِ
[Al-Baqarah 2:203]
in the book of Ibn Kathir, and also in the statement of one of the appointed muftis: that the one who hurries is not permitted to leave Makkah al-Mukarramah except on the third day of the blessed 'Id al-Adha. The mufti also said: that it is permissible to slaughter the sacrificial animals on the fourth day. In this case, the statement in *al-Mughni* agrees with the statements in the books mentioned above. If these statements are correct, how are these statements reconciled with the hadith that was narrated by Imam Ahmad and the people of the Sunan with a sound chain : that he said (peace and blessings be upon him):
The days of Mina are three, so whoever hastens (leaving after) two days, then there is no sin upon him, and whoever delays, then there is no sin upon him.أيام منى ثلاثة، فمن تعجل في يومين فلا إثم عليه، ومن تأخر فلا إثم عليه

, and this hadith, in my view and Allah knows best, indicates that the one who hurries is permitted to leave Makkah on the second day of the days of 'Id al-Adha; because it said: the days of Mina are three, and it did not say: the nights of Mina are three, as stated in *al-Mughni* and the statements found in the books mentioned above.


A: There is no contradiction between the verse and the hadith mentioned in the question, and what was mentioned in the book *al-Rawd al-Murba'* and the book *al-Muntaha* does not contradict them, nor does what came in the tafsir of Ibn Kathir (may Allah have mercy on him) of the verse. For the nights of Mina are three, considered along with their days, and their three days are considered along with their preceding nights. Accordingly, the one who hurries is the one who is content with staying overnight in Mina on the nights of the eleventh and twelfth of Dhu al-Hijjah, and stoning the pillars on each of those days after the sun passes its zenith. He has the option to depart from Makkah to his home or place of residence after stoning the pillars, as mentioned, before the sunset of the twelfth day, and then perform the farewell tawaf. As for the one who does not hurry, he is the one who remains in Mina on the night of the thirteenth of Dhu al-Hijjah and its day until he stones the pillars after the sun passes its zenith on the thirteenth of Dhu al-Hijjah. When he has stoned them after the zenith, he travels after performing the farewell tawaf. All of this is on the condition that he had previously performed the tawaf of ifadah; otherwise, he intends with his final tawaf both ifadah and farewell. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
