Answer: The two days that Allah (Mighty and Majestic) permitted the one who hurries to depart from Mina after their completion are the second and third days of the festival. This is because the day of the festival is the greatest day of Hajj, and the days of Tashriq are the three days that follow the day of the festival. These are the place for stoning the pillars and the remembrance of Allah (Mighty and Majestic). So, the one who hurries departs before the setting of the sun on the day of the twelfth. And if the sun sets on him on this day while he is in Mina, it is obligatory for him to stay overnight and throw the stones on the day of the thirteenth. This is what the Prophet (peace and blessings be upon him) and his Companions did. The one who departs on the day of the eleventh has neglected what is obligatory upon him regarding the stoning, so he must offer a sacrificial animal to be slaughtered in Mecca for the poor.
As for his leaving the overnight stay in Mina on the night of the twelfth, he must give charity with what is easy for him for that, along with repentance and seeking forgiveness for the negligence and hurrying out of its proper time that occurred from him. And if he offers a sacrificial animal for that, it is more cautious because of the exit from scholarly disagreement; because some of the scholars of knowledge hold that a sacrificial animal is required of him for leaving one night of the nights of the eleventh and twelfth without a Shari'ah excuse.
