Developing the one-third share and placing it in fixed real estate

Machine translationRead the Arabic original
Fatwa number ( 3593 )
Q: I have a sum of nine hundred (900) riyals, the value of sheep that were designated as a bequest in the name of: Ali ibn Muhammad Mufarrih as a perpetual charity. When death came, he bequeathed that his share among the heirs be a bequest from
the right of his father, meaning his share of the sheep only. So this aforementioned amount remained with me. I ask you to issue a ruling on this matter
.

A: If the situation is as stated and what he bequeathed is one-third of the money he left or less, a trustee should be appointed for the bequest. He should purchase a share in real estate or similar fixed assets with the aforementioned amount, if that is feasible. If not, he should give the amount to someone to trade with it for a share of the profit. If that is not possible, it should be spent on acts of charity, such as distributing it to the poor or using it to build a mosque or the like. All of this is to be carried out by the trustee of the bequest in consultation with the honorable judge of the region. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
