Q: My father passed away before performing the obligatory Hajj. Before his death, he willed that one of his farms be sold so that someone could be hired to perform the obligatory Hajj on his behalf. However, I hired someone to perform the Hajj without selling the land. Therefore, I ask for your guidance: does what I did suffice, or am I required to sell the land as stated in the will? If selling the land is necessary, do the heirs have the right to purchase it, or must the sale be to a non-heir? Please inform us. May Allah reward you with good.
A: Your performance of the Hajj on behalf of your father is sufficient, and it is not obligatory to sell the land, as the intended purpose is achieved without the sale. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
