Fatwa number ( 15300 )
Q: I have donated a portion of my agricultural land named: (Al-Khaybiyah), located in the 'Asir \ Bani 'Amr region, to the community a long time ago for the purpose of expanding the old mosque so that it would become a congregational mosque serving the general population of the village. This portion was transferred to the Ministry of Hajj and Endowments at that time. However, these days the community, may Allah reward them with good, built a congregational mosque other than the old one, and the old mosque remained as it was. Therefore, I ask: Do I have the right to reclaim the donated portion of my land as long as they have not attached it to the old mosque, since the aforementioned portion has been left unused, or is that not permissible for me? I ask you to issue a ruling on this, and may Allah not deprive you of reward and recompense.
A: You do not have the right to take back the aforementioned land, because you endowed it for Allah and transferred it to the responsible authorities. We hope for you great reward in that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
