Reverting a Waqf (Endowment)
Machine translationRead the Arabic original
The fourth question of Fatwa No. ( 4603 )
Q4: Is it valid for a man who has established a mosque under his house where congregational prayers are held, but the Friday prayer is not, to convert it into something else, for example a shop or the like, other than a mosque, if he wishes to do so or needs to?
A4: If a Muslim establishes a mosque under his house to pray in it, and leaves it open for people to pray in it, it is not permissible for him to revert it, whether by making it a residence or a shop, or by selling it, renting it out, or any other form of disposal, even if the Friday prayer is not held in it. This is because by establishing it as a mosque and leaving it open for people, it has become a waqf (endowment) that has exited his ownership; it is not to be sold, gifted, or inherited. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
