Q4: A man left his land for the public road and built a house next to it. After more than thirty or forty years, his grandchildren came and built a house on the land that their grandfather had left for the public road. What is the ruling on this?
A4: If a man leaves his land for people to pass over, intending thereby to make it an endowment or uttering the words of endowment, it becomes an endowment, and it is not permissible for him or his children to reclaim it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
