The first question of Fatwa No. ( 16337 )
Q1: A man came to me and said, "Give me a sum of (23,000 twenty-three thousand riyals), and after a year I will give you a Datsun Gama, one-door, model 94." Is this permissible or not?
A1: It is permissible to give a person a sum of money on the condition that he returns a car in exchange, provided that the car is defined by its description, and that this is of the nature of salam, which is paying the price in advance and deferring the delivery of the item; because the car is defined by its description. However, it is required that the full price be received in the session of the contract, and that the term be known. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
