Q: What is the ruling on the following sale: a forward sale (salam) that meets the following conditions:
1 - The item sold has a defined description. 2 - Saudi wheat, locally produced. 3 - It is in season and available to many people. 4 - It is of good quality, with quality assessed by computer at the silos. 5 - The quantity is known by weight in tons, as everyone delivers it by the ton. 6 - It has a known term, to be received after the harvest. 7 - The forward sale was made on the basis of the description, not on a specific item, and the price was paid in full in cash at the contract meeting. The condition was that delivery be at the silos, since all grains are received by the silos? Knowing that the price of grain at the silos is not fixed, as happened previously, where it dropped twice, and the sale was for the seller’s need for cash. Please inform us, may Allah reward you with good.
A: One who buys food by a forward sale (salam) contract or otherwise is not permitted to sell it until he takes possession of it by measuring or weighing it and bringing it to his place; because he (peace and blessings be upon him)Muwatta Malik 31:51 And Allah knows best.
