Q: There is a man who has a sum of money belonging to another man. The owner denied the debt and took an oath from him. Then he wanted to pay the amount to the owner's heirs because the owner has passed away, and he thinks they will refuse to accept it. What should he do if they refuse to accept it? Should he give it in charity with the intention of the deceased, or what should he do? Please issue a ruling for us, may Allah reward you, may Allah preserve you.
A: The questioner must seek forgiveness from Allah and repent to Him for this great sin. He must deliver the right to its rightful owner according to the Shari'ah through a Shari'ah judge. If the heirs do not accept it, he should give it in charity or contribute it to some charitable projects, such as building mosques, with the intention of it being on behalf of the deceased. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
