Q1: My brother passed away, and I owe him a debt of (30,000 Moroccan dirhams). I know that he has no children, but he has a wife, a mother, a father, three sisters, and a brother. I am the second brother, and I want to pay off the debt. What is obligatory for me to do?
A1: It is obligatory for you to hand over the debt you owe to your brother's heirs, who are his wife, his mother, and his father, if the situation is as you described in the question. The siblings have no share, because the father excludes them. As for the division of the estate, if the situation is as mentioned, it is divided into twelve parts: the wife gets one-quarter, which is three parts; the mother gets one-sixth, which is two parts; and the remaining seven parts go to the father. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family.
