Q: We have companies here, and people invest in them. They buy names from people who have nationality, meaning: proving that he is a citizen with that name. The person with the name has a nationality and has photographed it, then he sells the photo to people who invest in the company on his behalf. And he, whenever a company obtains a nationality photo and sells its photo to whoever comes to buy, says: This is a type of investment, like the date palm and the sheep selling its wool, and the date palm selling its dates, palm fronds, fiber, and firewood. The name is not sold to the company. And the buyer to whom I am selling invests in the company, and asks me to sign for him at the company a type of proof that I am the one who sold to him, and the signature is at the bank. As for me, I sell to people who hand me cash, and I photograph the wallet and give him its photo.
A: Granting citizenship by the state to an individual, and the status of an individual enjoying that citizenship, are subject to regulations. These regulations may vary from one country to another. Therefore, whoever deals with what the questioner mentioned must adhere to the regulations of his state, provided they do not conflict with Islamic law. This is part of cooperating in
righteousness and piety, and Allah the Exalted has commanded this in His saying:
cooperate in righteousness and pietyوَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى
[Al-Ma'idah 5:2]
. Departing from these regulations in a way that brings corruption to the individual, society, and the state is part of cooperating in sin and aggression, and Allah has forbidden this in His saying:
but do not cooperate in sin and aggressionوَلاَ تَعَاوَنُوا عَلَى الإِثْمِ وَالْعُدْوَانِ
[Al-Ma'idah 5:2]
. Furthermore, given the situation described, the person assumes the name of the citizenship holder as if he were the partner, whereas the matter is otherwise. Thus, this transaction is based on lying, deception, and fraud, which is not permissible. Moreover, taking money in this manner is consuming what is forbidden from both sides, because each of them takes the money through a forbidden means, namely lying, deception, and betrayal of the state.
