Q: My sister's son's father passed away when he was very young, and then his mother married another man who took her and her son to Kuwait , where he works. In good faith, the man added the boy to his nationality as his own son, and the boy was three years old at the time. The boy studied, graduated, and got a job, all based on the assumption that he was that man's son. This is in Kuwait , but in Saudi Arabia he obtained his ID card under his real name. Among people, he identifies with his real father, except in written matters, where all his certificates and documents are under his second name. First: Is there anything wrong with that? Knowing that he has no choice, for if he wanted to correct his name, his professional life would be turned upside down. Second: The aforementioned boy came to me seeking to marry my daughter, and I am his maternal uncle. I want to marry him to her, and I presented the matter to the girl and her mother, and they agreed, and we informed him of this.
But we are forced to contract the marriage under his assumed name; because his professional life in Kuwait is entirely under that name. Is this permissible or not? May Allah preserve you.

A: It is obligatory for your sister's son to correct his name in accordance with the correct ID card; because it is not permissible for a Muslim to claim descent from other than his father, as the authentic hadiths from the Messenger of Allah (peace and blessings be upon him) indicate, and as the saying of Allah the Exalted indicates:
Call them by their fathersادْعُوهُمْ لآبَائِهِمْ
the verse. And it should not be accepted based on his ID card that contradicts the Shari'ah; because he has no work in it; since it was written during his childhood. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
