Q: I traveled last year to perform the rites of Hajj in the year 1409 AH, and my wife and two daughters, one aged 8 and the other aged 6, were with me. My wife, the two daughters, and I entered the state of ihram from the miqat with the intention of Hajj, and we did not say, nor did we intend: “If I am prevented, then I am released where I am prevented.” Then I entered Makkah , and the type of Hajj was ifrad.
I performed the tawaf and sa'y on the 7th of Dhul-Hijjah, then I headed to Mina and spent the 8th of Dhul-Hijjah there, then I headed to 'Arafah on the 9th of Dhul-Hijjah, and I remained at 'Arafah until after sunset. In the middle of the Day of 'Arafah , I fell ill and took medication, but my health worsened and did not improve. However, after the sun set on the Day of 'Arafah , I headed to Muzdalifah , where I slept until Fajr, and I was like a lifeless body. An ambulance took me to the Mina hospital, and I spent the entire day of the festival in the hospital. I was unable to perform the tawaf of ifadah, and I did not stone the pillars. My children were with me and did not do anything, and I did not appoint anyone to stone the pillars on my behalf. At the end of the day of the festival, I left the hospital while still ill. I put on my sewn clothes and left Makkah without performing tawaf or stoning. I arrived in Ta'if and did not know what to do. I then entered a hospital in Ta'if and then left it, but no one guided me on what to do. Then I returned to Najran . What should I do about the tawaf of ifadah that I did not perform in its proper time? What should I do about the stoning that I did not perform? What should I do since I wore sewn clothes before the tawaf and stoning, and I had intercourse with my wife before the first tahallul, meaning after I arrived in Najran ? What should I do about my daughters, since each daughter intended Hajj with us? I ask your eminence to clarify what is obligatory for me to do now, so that
I may please Allah the Mighty and Majestic. I am afraid of the punishment of Allah, and I strive hard to obey Him. I ask Allah the Mighty and Majestic to bless you and to keep you successful in advising, guiding, and teaching the Muslims, especially since you are a good role model for the Muslims, and people of knowledge and piety. I ask your eminence to kindly send the reply in writing to my address so that I can offer the sacrifices in obedience to Allah, asking the Lord the Mighty and Majestic to accept from us.
A: You must return to Makkah and perform the tawaf for Hajj, and the tawaf of farewell when leaving Makkah . You must shave or shorten your hair with the intention of Hajj, and your wife and the two daughters must shorten their hair with the intention of Hajj. You, your wife, and the two daughters owe a sacrificial animal for leaving the stoning, and another sacrificial animal for leaving the overnight stay in Mina . These are to be slaughtered in Makkah and distributed to the poor. A camel or a cow suffices for you, provided one additional sheep is added, because the total number of sacrificial animals owed by you collectively is eight. A camel or a cow suffices for seven, and you must add one additional sacrifice to complete the number, as mentioned. You owe another camel because of your intercourse with your wife before the first tahallul, and she is like you. These two are to be slaughtered in Makkah and distributed to the poor in Makkah . You and your wife must perform Hajj again in place of this Hajj, from the miqat from which you entered the state of ihram for the first Hajj that was invalidated, because your Hajj and your wife's Hajj were invalidated
due to intercourse before the first tahallul. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
