The Tamattu' Pilgrim: When to Enter the State of Ihram for Hajj

Machine translationRead the Arabic original
Fatwa No. ( 10888 )
Q: Allah has blessed me with the performance of the obligatory Hajj this year with my husband's father and mother; because my husband's work circumstances in the Kingdom did not allow him to accompany us, and I remained in Makkah for a full month, during which I performed 'Umrah and intended tamattu' Hajj, and my question now is: We entered the state of ihram for Hajj on the seventh of Dhu al-Hijjah, and I entered ihram with them as well, then we proceeded directly to 'Arafah , where we stayed on the seventh, eighth, and ninth of Dhu al-Hijjah. Is what we did valid? And what is the ruling if it is not? While we were traveling from 'Arafah to Muzdalifah , my daughter and I got lost
The way, and I strayed from those who were with me, but Allah made it easy for me, and praise be to Allah, an Egyptian brother and his wife stayed with me until going to Makkah for the Farewell Tawaf. I was dependent on them to take me to Jeddah , where I can go to my husband's parents and my child who was with them. Due to these circumstances, I intended to combine the Tawaf of Ifadah and the Farewell Tawaf. The driver gave us a two-hour grace period to return and then go to Jeddah . The sister told me that it is permissible to perform Sa'y then Tawaf, because if I performed Tawaf, my last act with the House would have to be Tawaf. So I performed Sa'y then Tawaf, and I was hurrying during that because my daughter was with them and I feared falling behind them. After returning, I read that one of the conditions for the validity of Sa'y is that Tawaf precedes it. The question is: Is Sa'y before the Farewell Tawaf permissible? And what is the ruling if what I did is not correct? And if I am required to offer a sacrifice, can I appoint someone to slaughter it on my behalf in Makkah since it is impossible for me to go to Makkah now, and perhaps not even until I return to Egypt ?

A: First: It is prescribed for the one in Makkah who intends Hajj to enter the state of ihram on the eighth of Dhu al-Hijjah, and to stay in Mina on the eighth day, praying Dhuhr, 'Asr, Maghrib, 'Isha, and Fajr there, then to go to 'Arafah on the morning of the ninth day after the sun rises. However, if one does not do that and goes to 'Arafah before that, it does not affect his Hajj. Second: It is prescribed to perform Sa'y for Hajj after Tawaf, but if you performed Sa'y
before Tawaf and intended with it the Tawaf of Hajj and the Farewell Tawaf, then traveled, that suffices you, and nothing is required of you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
