Q: I performed my first Hajj when I was 18 years old, and at that time I was studying in Makkah al-Mukarramah . From the beginning of the month of Dhu al-Hijjah, I worked as an employee with a mutawwif, guiding the pilgrims in their tawaf. On the morning of the eighth day, I entered the state of ihram from Makkah , but I did not perform tawaf or sa'y . On the ninth day, I stood at 'Arafah , then I did not spend the night at Muzdalifah due to my work commitment with the mutawwif. On the tenth day, I stoned the pillars, then I shortened my hair and exited my state of ihram. On the eleventh and twelfth days, I stoned the pillars. Then, out of ignorance, I did not perform the tawaf of ifadah or sa'y. After that, I left my job with the mutawwif and went to Ta'if without performing the farewell tawaf. A few days later, I returned to Makkah for my studies. Two years later, I contracted a marriage and got married, and since I was doubtful about the validity of my first Hajj, I decided to perform a second Hajj, but not with the intention of repeating the first one. So I performed the second Hajj and fulfilled all its pillars and obligations as they should be. Then, three years after that, I performed a third Hajj with my wife. My question, O honorable Shaykh: What is obligatory upon me regarding the first Hajj, given that I believe I went to Ta'if that year to visit my relatives, then I returned to Makkah at the end of the month of Dhu al-Qa'dah and passed the miqat without entering ihram for that Hajj? And what about the marriage contract?
A: If the matter is as you described, then it is obligatory for you to come to
Makkah and perform the tawaf of ifadah and sa'y after it for the first Hajj. If you had sexual intercourse with your wife, then in addition to what we mentioned, you must slaughter a fidyah, which is a sheep that is acceptable as an 'Id sacrifice, and distribute it to the poor of the Haram. If you do not find one, then you fast for ten days. There is nothing upon you for not spending the night at Muzdalifah , because you were unable to do so due to your commitment to working with the pilgrims who are under the mutawwif, as you mentioned. The marriage contract is valid according to the most correct of the scholars' opinions, because it took place after the first exit from ihram. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
