Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the General President from the Honorable President of the Grand Court of al-Mubarraz, referred to the Committee by the General Secretariat of the Council of Senior Scholars, with number (347) and date 20 \ 1 \ 1413 AH. His Eminence asked a question, the text of which is: I seek your Eminence's intercession regarding copies of the two judgments issued by this court with number (162) on 23 \ 6 \ 1356 AH, and number (715) on 7 \ 10 \ 1390 AH, concerning the endowment of certain properties, among whose specified conditions is the recitation of specific surahs from the Qur'an, as well as two portions every day. The guardian mentions that he is unable to carry this out according to the endower's condition,
due to the tightness of his time, and he is hesitant to leave it off, and he requests a ruling: Is there a substitute for this? Is it permissible for him to hire someone to do it on his behalf? And does he bear sin for leaving off the recitation during the past period? Therefore, I hope you will kindly provide the information. And peace be upon you.
After the Committee studied the inquiry, it answered that the condition of the endower to allocate a portion of the endowment's revenue to whoever recites al-Fatihah or a portion of the Qur'an and dedicates its reward to the deceased, or to him and others, is a non-Shari'ah expenditure; because the reward of reciting the Qur'an is not dedicated to the dead; due to the absence of a text stating this, this being the most correct of the scholars' opinions. Therefore, the mentioned condition is not considered one of the Shari'ah expenditures of the endowment, and accordingly, the portion allocated from the endowment for this purpose is to be directed to charitable Qur'an memorization schools; because this is closer to the endower's objective and of the same kind. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
