Q: A person gave another person a head of sheep as a charity, and this head increased and grew until it became a flock of sheep. The recipient gives charity, gives gifts, and slaughters from the offspring of this charity. It came to his knowledge that the reward and recompense belong to the original owner of the gift, and not
to the second person. Is this correct, and what is your view regarding this? Because the sheep have become numerous, and their current owner sells and sacrifices from them on the basis that they have become his private property, as they were gifted to him years ago. Please inform us, may Allah reward you with the best reward.
A: If the recipient accepts the gift, it becomes his property, and he may dispose of it according to the Shari'ah guidelines. He is rewarded if he gives charity from it, because it is his property. Therefore, the sheep are the property of the recipient, and he has the reward if he gives charity from them or slaughters an 'Id sacrifice from them. The original giver has the reward of his gift if he intended the reward and recompense with it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
