Q: I have a son and a daughter who passed away (may Allah have mercy on them), and I have a plot of land. Is it permissible for me to endow from my entire wealth the development of this land into two houses, one for each of them, so that its rental income is spent on them for the 'Id sacrifice, Hajj, and acts of righteousness, with the reward and wage for them, under the supervision of the agent? Also, I have a house that I have already endowed and included them in the reward, but I want to divide this land and develop it so that each has a specific house for himself. Note that the heirs are not pleased with this and say that it is not permissible; they say this is a transfer of ownership and is not valid. I ask you to issue a fatwa for me, may Allah reward you with good. The fatwa should be in writing. And if it is permissible, is it valid to transfer this land before its development, after I have endowed it, to a place I prefer for renting for the benefit of the deceased? I ask for a fatwa from the honorable Shaykh 'Abd al-'Aziz, may Allah grant him success in good.
