Q2: If men are late for the congregation in the mosque and find that the people have already prayed, is it permissible for them to pray another congregation in the mosque, or not? Is there a contradiction between the hadith

and the statement of Ibn Mas'ud (may Allah be pleased with him), or others: "When we missed the congregation or the congregation ended, we would pray individually," or as he (may Allah be pleased with him) said?

Part 2: If a person comes to the mosque and finds that the congregation has already prayed with a regular imam or a non-regular imam, let him pray in congregation with those like him who missed the congregation, or let some of those who have already prayed pray with him; for what was narrated by Ahmad in his Musnad, and by Abu Dawud in his Sunan, from Abu Sa'id al-Khudri (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) saw a man praying alone and said:
“Will no one give alms* to this man and pray along with him?” Thereupon a man got up and prayed along with him.ألا رجل يتصدق على هذا فيصلي معه فقام رجل فصلى معه

, and it was narrated by al-Tirmidhi from Abu Sa'id (may Allah be pleased with him), who said:
A man came, and the Messenger of Allah (peace and blessings be upon him) had already prayed, so he said: "Which of you will give charity to this man by praying with him?" So a man stood up and prayed with him.جاء رجل وقد صلى رسول الله صلى الله عليه وسلم فقال: أيكم يأتجر على هذا؟ فقام رجل فصلى معه
. Al-Tirmidhi said: It is a good hadith. It was also narrated by al-Hakim , who graded it authentic, and al-Dhahabi agreed with him on that. Ibn Hazm mentioned it in (al-Muhalla) and indicated its authenticity. Abu 'Isa al-Tirmidhi said: This is the view of more than one of the Companions and the Successors, who said: There is no harm in people praying in congregation in a mosque where a congregation has already been prayed.
There is a congregation, and this is the view of Ahmad and Ishaq . Others said: They should pray individually, and this is the view of Sufyan and Ibn al-Mubarak and Malik and al-Shafi'i , who prefer praying individually. End of quote. These scholars and those who agreed with them disliked this out of fear of division, the breeding of grudges, and that people of desires might take this as an excuse to delay joining the congregation, so that they might pray in another congregation behind an imam who agrees with their creed and innovation. Therefore, to block the door to division and to put an end to the bad intentions of people of desires, it is that an obligatory prayer in congregation should not be prayed in a mosque after a congregation has already been prayed in it, whether with a regular imam or any imam. The first opinion is the correct one; due to the hadith mentioned above; because of the generality of the saying of Allah the Exalted:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[At-Taghabun 64:16]
, and the saying of the Messenger of Allah (peace and blessings be upon him)
And if I order you to do something, then do of it as much as you can.إذا أمرتكم بأمر فأتوا منه ما استطعتم

. There is no doubt that the congregation is part of the fear of Allah and what the Shari'ah has commanded, so one should strive for it to the best of one's ability. It is not correct to oppose authentic transmission with reasons seen by some scholars who disliked repeating the congregation in the mosque for those reasons. Rather, it is obligatory to act according to what the authentic transmissions indicate. If it is known that a person or a group delays out of negligence and this repeats from them, or if it is known from their signs and creed that they delay to pray with their like, they should be excused and their hands should be held back by what is seen
ruler sees fit; to deter them and those like them from among the people of desires. By this, the door to division is blocked and the aims of the people of desires are put an end to, without abandoning the action based on the evidence that indicates praying in congregation for those who missed the first congregation. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
