Transferring a deposit to someone other than the trustee

The first question of Fatwa No. ( 5515 )
Q1: There is a Pakistani tailor next to our shop, and he traveled and did not return. He had a coat (jacket) belonging to a man named Musafir, and he asked us to take this coat and keep it with us until its owner comes. He also took from us the cost of the repair and said: If the owner of the coat comes, please
hand this to him and take the cost of the repair. But the owner of this coat has not come to collect it, and now it has been about two years since it was with us. What should I do with it? May Allah reward you a thousand times for us?

A1: If the situation is as described, the coat should be sold, and you should take the tailor’s fee. The remaining value should be given in charity to the poor, with the intention that the reward of the charity belongs to the owner. If the owner comes later, inform him of the situation. If he is satisfied, that is fine. If he is not satisfied, give him the value after deducting the cost of the tailoring, and the reward is yours, if Allah wills. If it is appraised and given in charity to a poor person, that is more complete, and you have the reward of what you handed over to the tailor.
