The first question of Fatwa No. ( 19659 )
Q1: A woman fell ill and left her gold with me, entrusting me with the responsibility that if she died, I should not give this gold to anyone, not to her mother or her husband, but rather keep it with me until her daughters reach the age of maturity; because they are still young. However, I am worried about this trust in the house being stolen if we leave the house to visit my relatives or go anywhere else. And if I carry it with me, I fear that, God forbid, an accident or something else might happen. In fact, a theft did occur in our house, but the gold was with me when I went to visit my relatives, so I became even more worried. We asked one of the scholars, and he said that the father has the right to keep this gold for his daughters. So I gave it to him and he took on the trust, just as the mother had entrusted it to me. I do not know if he will act upon this trust as his wife wished, or not. Is my action correct, and is my conscience cleared? Please inform us, may Allah reward you with good.
A1: This aforementioned money must be delivered to the heirs so that they may divide it among themselves; because it has become the right of all of them.
