The seventh question of Fatwa No. ( 3426 )
Q 7: A woman from Makkah rented out her house during the time of Hajj to pilgrims from al-Ahsa, and after the completion of the Hajj rites, one of the pilgrims asked her to keep a wooden bowl and a tent with her. She refused out of fear of the trust, but he promised her that he would return after six months to take it, and she agreed without taking the man's name or address. After the period passed, the man returned and asked for the trust, but the one who opened the door for him was the woman's husband, who knew about the trust. He said to the man: "You have nothing
with us; the bowl broke." When the woman learned of this, she began to blame her husband for this action, then she began searching for the man, but unfortunately he had left, and she did not know where he was or his address. She is now crying whenever she hears stories about trusts. What must she do? Should she estimate its value and give it in charity? Note: She said to her husband: "Why did you do that?" He said: "I will bear this trust."
A: As for the husband, he is sinful in this action of his. And you must estimate the value of the bowl and the tent and give the value in charity to the poor with the intention of it being on behalf of its owner. If he returns again, inform him. If he asks for the value, pay it to him, and the charity will be for you. If he accepts the charity, its reward is for him.
