The fourth question of Fatwa No. ( 8442 )
Q4: Regarding the zakah of my father’s wealth (may Allah have mercy on him), my father used to pay the zakah in the last days of the blessed month of Ramadan. Since my father passed away before the arrival of the blessed month of Ramadan, we do not know what to do regarding it. Some of us objected on the grounds that it is now the heirs’ wealth, not the deceased’s wealth. Some of us said that the zakah should be paid from only the one-third of his wealth that he bequeathed. And some of us said that the zakah should be paid and counted from the one-third of the wealth that he bequeathed. Please advise us, may Allah reward you with good.
A4: Zakah is not obligatory until the completion of the lunar year. With the death of your father, the wealth transferred to the heirs, so zakah is not obligatory on it as long as the lunar year has not been completed. The zakah lunar year for you begins from the day of your father’s death. As for the one-third, there is no zakah on it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
