Q: I present to your eminence that my father (may Allah have mercy on him) passed away on the 24th of Dhul-Hijjah, 1415 AH, that is, six days before the completion of the lunar year on his wealth. The heirs disagreed among themselves; some hold that it is obligatory
to pay zakah on his wealth, as it is purer for the wealth, while others hold that zakah is not obligatory on this wealth. We ask your eminence to inform us whether zakah is obligatory or not in this case? It is known that the zakah for the year 1414 AH was paid in full.
A: If the situation is as mentioned in the question, namely the death of your father before the completion of the lunar year, then there is no zakah on the deceased; because he died before the completion of the lunar year on the wealth. It is obligatory for every heir to pay zakah on his share of the inheritance if it reaches the nisab or more, either by itself or by combining it with other money or trade goods, and the lunar year has passed on it from the time of the deceased's death. The amount of zakah is one-quarter of a tenth (2.5%). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
