Q3: What is the ruling on performing the funeral prayer for one who was killed in retaliation or on whom the hadd for unlawful sexual intercourse was carried out, and is that considered an expiation for him?
A3: First: The funeral prayer for every Muslim who dies, as long as he appears to be a Muslim, even if he has committed a major sin other than shirk (associating partners with Allah), is a collective obligation (fard kifayah). For one on whom the hadd of stoning was carried out or one who was killed in retaliation, the funeral prayer is performed for them. Second: The correct opinion among the scholars is that the hadd punishments are expiations for the sins for which they were imposed, based on the established hadith of 'Ubadah ibn al-Samit (may Allah be pleased with him), in which the Prophet (peace and blessings be upon him) said to his companions:
Pledge allegiance to me that you will not associate anything with Allah, that you will not commit unlawful sexual intercourse, that you will not steal, and that you will not kill the soul which Allah has made sacred except by right. Whoever among you fulfills this, his reward is with Allah. And whoever among you commits any of these and is punished for it in this world, that is an expiation for him. And whoever among you commits any of these and Allah covers it up, his affair is left to Allah; if He wills, He will punish him, and if He wills, He will forgive him. He said: So we pledged allegiance to him on that.بايعوني على ألا تشركوا بالله شيئًا، ولا تزنوا ولا تسرقوا، ولا تقتلوا النفس التي حرم الله إلا بالحق، فمن وفى منكم فأجره على الله، ومن أصاب منكم شيئًا من ذلك فعوقب به في الدنيا فهو كفارة له، ومن أصاب شيئًا من ذلك فستره الله عليه فأمره إلى الله؛ إن شاء عذبه، وإن شاء غفر له، قال: فبايعناه على ذلك
