Q8: If a man has intercourse with his wife and sleeps, and then wakes up late in the morning, is it permissible for him to perform wudu' and pray without ghusl; either because the time is tight, or because the water is cold and he delays until another time, or is it not permissible for me to pray while in a state of janabah regardless of the situation?
A8: He must perform ghusl from janabah for prayer, and wudu' is not sufficient for him, nor is tayammum acceptable if he is able to access water, even by purchasing it; because the time of his waking is the time of his prayer; due to the saying of the Prophet:
Whoever sleeps through a prayer or forgets it, let him pray it when he remembers it. There is no expiation for it except that.من نام عن صلاة أو نسيها فليصلها إذا ذكرها، لا كفارة لها إلا ذلك
It is agreed upon as authentic. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
